The purpose of these General Terms and Conditions of Sale (GTCS) is to define the rights and obligations of the parties in the context of boat rental offered by AXO BOAT SXM.

1. OBJECT

These General Terms and Conditions apply to all boat rental reservations made with AXO BOAT SXM, whether made online via the https://axoboatsxm.com website, by telephone, or in person at the company’s head office.

2. BOOKING AND ACCEPTANCE OF TERMS AND CONDITIONS

All bookings imply full acceptance of these terms and conditions by the customer. The customer acknowledges having read and understood these terms and conditions before confirming the reservation.

3. PRICES AND TERMS OF PAYMENT

Boat rental prices are quoted in euros (€) and dollars ($), all taxes included.
The balance must be paid 1 day before the rental date.
Accepted payment methods are: credit card and PayPal.
Any reservation not followed by payment is considered null and void.

4. CANCELLATION POLICY

Cancellation by the customer :
- In the event of cancellation more than 30 days before the rental date: full refund.
- In the event of cancellation between 30 days and 15 days before the rental date: 50% of the amount will be retained.
- In the event of cancellation less than 3 days before the rental date: no refund will be made.
Cancellation by AXO BOAT SXM :
- In the event of cancellation for weather or technical reasons beyond AXO BOAT SXM’s control, a postponement will be offered or a full refund will be made.

5. BOOKING MODIFICATION

All requests for booking changes (change of date, rental period, boat, etc.) must be made at least 15 days before the scheduled rental date and are subject to boat availability. Additional charges may apply depending on the changes requested.

6. USING THE BOAT

The customer undertakes to use the boat with due care, in accordance with maritime safety rules and current legislation. It is strictly forbidden to:

Exceeding the maximum authorized passenger capacity.
To use the boat without the captain appointed by AXO BOAT SXM on board.
Subletting the boat or transferring it to third parties.

In the event of non-compliance with these rules, AXO BOAT SXM reserves the right to cancel the rental without refund.

7. INSURANCE

All boats rented by AXO BOAT SXM are covered by third-party liability and comprehensive insurance. However, this insurance does not cover irresponsible behavior or damage caused intentionally. The customer is responsible for any damage caused by his or her own negligence, and will bear the cost of repair or replacement.

8. LIABILITY

AXO BOAT SXM declines all responsibility for personal injury or material damage caused by improper use of the boat. The customer is solely responsible for his or her own actions, as well as for the actions of any persons on board with him or her.

9. DISPUTES

In the event of a dispute relating to the validity, interpretation or performance of these GTS, the parties agree to attempt to resolve the dispute amicably. Failing amicable settlement, the dispute will be brought before the competent courts of Saint-Martin.

10. PROTECTION OF PERSONAL DATA

In accordance with the French Data Protection Act n°78-17 of January 6, 1978 and the RGPD (General Data Protection Regulation), personal data collected by AXO BOAT SXM is used solely for the purpose of managing bookings. Customers have the right to access, rectify and delete any data concerning them by contacting AXO BOAT SXM by email at yvanmarajo@hotmail.com.

11. MODIFICATION OF TERMS AND CONDITIONS

AXO BOAT SXM reserves the right to modify these terms and conditions at any time. The applicable conditions are those in force on the date of the reservation by the customer.
